Lien Release

In Plain English

An official document that removes a lien from a property's records after the debt is paid.

Definition

A lien release is a recorded document that formally discharges or removes a mechanic's lien from the property records once the underlying debt has been paid or resolved. After signing a lien waiver and receiving payment, the party who filed the lien must record a release with the county recorder's office to clear the cloud on title. Failure to timely release a lien after payment can expose the lien claimant to liability for damages.

Why It Matters in Bidding

Clearing a recorded lien is what actually allows an owner to refinance, sell, or close out a project, so estimators and GCs treat timely releases as part of payment administration. Tracking releases against payments protects the GC from owner backcharges and keeps title clean for final draws and retainage. A claimant who fails to release after payment risks damages and strained future relationships.

Example

After receiving final payment and retainage on a retail buildout, the electrical subcontractor records a lien release with the county recorder so the owner can clear title before selling the property.

A lien release is the recorded document that removes an already-filed lien from the property records. One prevents a lien; the other discharges an existing one.
The party that filed the lien must record the release with the county recorder once the debt is satisfied. Owners and GCs typically condition final payment or retainage on receiving the recorded release, since it is the step that actually clears the cloud on title for sale or refinancing.
An unreleased lien leaves a cloud on title that can block a sale, refinance, or final draw. Many states impose deadlines for releasing a satisfied lien and expose the claimant to liability for resulting damages and even penalties, making prompt release both a legal duty and a relationship safeguard.
